RSA Watersports SL operates under the commercial brands Mallorca Watersports and eFoil Club and is responsible for all services, bookings, rentals, sales and activities offered through this website.

SCOPE OF APPLICATION
These Terms and Conditions govern access to and use of the website www.mallorcawatersports.com, as well as all bookings, rentals, purchases, events and services provided by RSA Watersports SL.
By accessing the website, making a booking, renting equipment, purchasing products or participating in any activity, the user agrees to be bound by these Terms and Conditions.
RSA Watersports SL reserves the right to modify these Terms and Conditions at any time. The version published at the time of the booking or purchase shall apply.
SERVICES OFFERED
RSA Watersports SL offers rental of watersports equipment, guided experiences, private or group events, customized activities, product sales and services related to the nautical and watersports sector.
All services are subject to availability, weather conditions, safety requirements and operational capacity.
BOOKINGS AND PAYMENTS
Bookings may be made through the website or other authorized platforms.
A booking shall be considered confirmed once the required payment has been successfully processed. RSA Watersports SL reserves the right to reject or cancel any booking for safety reasons, adverse weather conditions, technical errors, suspicion of fraud or operational limitations.
All prices are shown in euros unless otherwise stated. RSA Watersports SL reserves the right to modify prices at any time, without affecting already confirmed bookings.
CANCELLATION POLICY – EQUIPMENT RENTALS
For standard equipment rentals, the client may cancel free of charge up to 48 hours before the scheduled start time of the activity.
Cancellations made less than 48 hours in advance shall be at the discretion of RSA Watersports SL. The company may decide whether a full refund, partial refund, voucher issuance or no refund will apply, depending on the circumstances and operational impact.
As these services are contracted for a specific date and time, the statutory right of withdrawal provided under consumer protection regulations shall not apply once the booking has been confirmed for a specific execution date.
CANCELLATION POLICY – PRIVATE EVENTS AND HIGH-VALUE GROUP BOOKINGS
In the case of private events, customized experiences or group bookings with a total amount exceeding 5,000 euros, cancellation must be made at least 15 calendar days prior to the scheduled event date in order to qualify for cancellation without penalty, unless otherwise agreed in writing.
Cancellations made less than 15 days in advance may result in partial or total retention of the amounts paid, depending on costs already incurred, resources allocated and commitments made to third parties.
Specific conditions may be detailed in quotations, contracts or individual agreements, which shall prevail in case of discrepancy.
SHIPPING POLICY
Standard shipping is available exclusively for deliveries within Mallorca.
For all other destinations, products will be shipped using mandatory insured transport. The cost shall be borne by the client and will be expressly indicated at the time of purchase.
SHIPPING, DELIVERY AND LIMITATION OF LIABILITY
Delivery times indicated at the time of purchase are estimates and may be affected by circumstances beyond the control of RSA Watersports SL, including but not limited to carrier delays, logistical incidents, customs procedures, manufacturer availability or force majeure events.
RSA Watersports SL shall not be liable for delivery delays attributable to the carrier, third parties, customs authorities or circumstances beyond its reasonable control.
The liability of RSA Watersports SL shall be limited to the proper management and coordination of the shipment in accordance with the information provided to the client.
In the event of visible damage to the packaging or apparent damage at the time of delivery, the client must note this on the carrier’s delivery receipt and notify RSA Watersports SL within a maximum period of 24 hours from receipt of the product, providing photographs and necessary documentation for claim management.
RIGHT OF CANCELLATION AND RETURNS
The client may cancel their order within a maximum period of 14 calendar days from the date of purchase.
In the event of cancellation, the client must return the product in perfect condition, unused and in its original packaging.
Initial shipping costs shall not be refunded under any circumstances.
The client shall also bear the direct costs of returning the product.
If the product shows signs of use, improper handling or deterioration, RSA Watersports SL may reject the return or apply the corresponding depreciation.
PARTICIPATION REQUIREMENTS AND LIABILITY WAIVER
All participants in watersports activities must be in suitable physical condition and must strictly follow the safety instructions provided by the staff.
Before participating, it is mandatory to sign a liability waiver document. In the case of minors, written authorization from a legal guardian is required.
Refusal to sign the required documentation may result in denial of participation without the right to a refund.
ASSUMPTION OF RISKS
Watersports activities involve inherent risks, including but not limited to falls, collisions, changing sea conditions, equipment malfunction and potential physical injuries.
By participating in the activities, the client acknowledges and accepts such risks. RSA Watersports SL shall not be liable for damages or injuries resulting from improper use of the equipment, failure to follow instructions or circumstances beyond its reasonable control.
RESPONSIBILITY FOR EQUIPMENT
The client is responsible for the proper use of the rented equipment and for returning it in the same condition as delivered.
Any damage resulting from misuse, negligence or failure to follow instructions may result in additional charges.
WEATHER CONDITIONS
All activities are subject to weather and sea conditions. RSA Watersports SL reserves the right to postpone or cancel activities when conditions are considered unsafe. In such cases, rescheduling or refund will be offered in accordance with the company’s reasonable discretion.
USE OF IMAGES AND AUDIOVISUAL MATERIAL
RSA Watersports SL may take photographs and record videos during activities for promotional, advertising and communication purposes on its website, social media and other marketing materials.
By participating in the activities, the client authorizes the use of such images unless they expressly communicate in writing, prior to the activity, their refusal to appear in promotional materials.
INTELLECTUAL PROPERTY
All content on the website, including texts, images, logos, trademarks and design, is protected by intellectual and industrial property regulations.
Any unauthorized reproduction or use is strictly prohibited.
GOVERNING LAW AND JURISDICTION
These Terms and Conditions are governed by Spanish law.
Any dispute arising from their interpretation or application shall be submitted to the competent courts and tribunals of Palma de Mallorca, Spain.
